Does a foreigner need to pay duties and register the car brought to Ukraine for a short time?



The procedure of crossing the Ukrainian border is regulated by the Customs Code of Ukraine (hereinafter “the Customs Code”). This document also provides for requirements and conditions of delivering vehicles to Ukraine and using them on its territory. Different customs rules apply to different types of vehicles yet in this article we will consider the most common case, i.e. when a foreign private individual (hereinafter “the Foreigner”) takes to Ukraine his/her private car (hereinafter “the Car”).

NOTE: We will not consider cases when a Foreigner comes to Ukraine for a long stay having a permanent or temporary residency certificate or another legitimate ground for staying in Ukraine over the period of time allowed by Ukrainian law.

A Car temporary taken to Ukraine by a Foreigner is not a subject of customs clearance (par. 8 cl. 10 art. 374 of the Customs Code). Peculiarities of a temporary usage of Cars in Ukraine are regulated by article 380 of the Customs Code of Ukraine.

According to the mentioned article 380, temporal importation of a Car is allowed for a period up to 1 year. In such a case, the Foreigner is not obliged to declare the Car with the customs. The same article says that the procedure of registration of Cars is determined by the Cabinet of Ministers of Ukraine. As of today, there is a valid Regulation of the Cabinet of Ministers of Ukraine No. 1388 dated September 7, 1998 (hereinafter “the Regulation”) that explains how to register the Car.

According to clause 7 of the Regulation, a Car temporary imported in Ukraine for a period longer than 2 months is to be registered with the State Traffic Police. The Car cannot be exploited by another person and be disassembled.

So a person who is not a Ukrainian national can bring his/her own car to Ukraine for a period up to 1 year without the obligation to pay customs duties for this car. At the same time, this person does not need to register the car with the Ukrainian traffic police unless the car has stayed in Ukraine over 2 months.
